The importance of Case Law

If Council refuses a given development application, the applicant may choose to appeal their decision, either through State planning controls, or, ultimately, the Land and Environment Court of New South Wales.

The document below is once such case: Holroyd City Council rejected an application for petrol station, carwash and convenience store. The applicant appealed the decision in the Land and Environment Court.

The Judgement

The Court found that the application was inconsistent with the broad objectives of the Zone and the application was refused.
